The following terms and conditions apply to the website and services offered by Harmony Bikes Limited. This includes the mobile and tablet versions as well as any other version of Harmony Bikes Limited accessible via desktop, mobile, tablet, social media or other devices.

By using the website and services, you represent and warrant that you have full right, power and authority to enter into this agreement and to fully perform all of your obligations hereunder. You further represent and warrant that you are not under any legal incapacity or contractual restriction that would prevent you from entering into this agreement.

 

2. ACCOUNT

Users must register and open an account on the website for the purpose of purchasing tours and memberships. If you register with Harmony Bikes Limited, you will be asked to choose a password and may be asked for additional information about your account. Users will be able to register using their Facebook and Google account information. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Harmony Bikes Limited of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you log out of your account at the end of each session. You may never use another user's account without Harmony Bikes Limited's prior authorization. Harmony Bikes Limited will not be liable for any loss or damage arising from your failure to comply with this agreement.

Users may cancel their accounts at any time and for any reason by following the instructions on the platform or by sending us their request through our contact information. Such cancellation will only result in the deletion of the account and the deletion of all personal data provided to Harmony Bikes Limited in accordance with our privacy policy.

Harmony Bikes Limited reserves the right to terminate your account or your access immediately, with or without notice, and without liability to you, if Harmony Bikes Limited believes that you have breached any of these terms, provided Harmony Bikes Limited with false or misleading information, or interfered with other users' use of the platform or the service.

By providing Harmony Bikes Limited with your email address, you agree that we may use your email address to send you important notices about the services. We may also use your email address to send you notifications and other messages, such as important changes to the services, relevant news and special content. If you do not wish to receive these emails, you may opt-out of receiving them by sending us your request through contact information or by using the "unsubscribe" option in emails. Opting out may prevent you from receiving notifications and alerts about services, relevant news and special content.

 

3. TOURS, HOLIDAYS AND RIDES

Users may purchase and book tours, rides and holidays by paying for the tour, vacation or ride individually. The rides, tours and holidays must be paid for through the website at the time of booking. These will mainly allow us to make the booking of accommodation in the case of holidays and the rental of bikes on daily tours.

By booking a tour, a ride or a holidays through the website, the user offers to purchase the services for the price advertised and indicated on the website at the time of booking and purchasing the corresponding vacation, tour and ride. Before booking and purchasing a tour, ride or holidays through the website, please check the features, content and availability in terms of time and date of each tour or ride and the starting dates of the holidays.

When a customer books a holidays, tour or ride through the website, Harmony Bikes Limited will send an email to confirm the purchase and the corresponding payment. This email will contain the information and details of your vacation, the relevant tour or ride and will be produced automatically so that the user has confirmation of their purchase and details of the tour, ride or vacation.

Harmony Bikes Limited may change or discontinue the availability of tours. rides and holidays at any time at its sole discretion. If a tour, ride or holidays is cancelled any payment made for the tour, ride or holidays in question will be refunded in full. This does not affect your statutory rights.

Harmony Bikes Limited may make changes to the dates, prices, times and itineraries of tours, rides and holidays at any time at its sole discretion. Harmony Bikes Limited may cancel, change or substitute the services purchased in connection with the tours, holidays and rides booked by the user. In such an event, the user will be informed of such changes and, if dissatisfied with such changes, may request a full refund for the holidays, tour or ride booked. If you wish to cancel a scheduled holidays, tour or ride for any reason, please contact us through our contact information.

 

4. PAYMENTS

Services (tours, rides and holidays) will be paid for by credit/debit card through the payment processors available from Harmony Bikes Limited. Payment will be charged to your credit or debit card immediately upon payment for the relevant service. Upon processing a transaction, we will issue an electronic receipt which will be sent to the email address you provided to us at the time of purchasing or scheduling the service. The email and transaction receipt may be sent via the payment processor available from Harmony Bikes Limited.

If you find any inconsistency in your billing, please contact us through our contact details or you can make the claim through the customer service of the relevant payment processor.

If your card is declined, you will receive an error message. No payment will be charged to your card and no payment will be processed. There may be a pending transaction on your account until your card issuing bank withdraws the authorisation. This usually takes 2 to 5 business days. Your card may be declined for a number of reasons, such as insufficient funds, AVS (Address Verification System) mismatch, or you have entered an incorrect security code.

If your payment is declined, you must provide an alternative payment method or provide another card on which the payment can be loaded and processed.

Harmony Bikes Limited reserves the right to determine the price of the services and to modify it at any time and without prior notice.

Your payment details will be processed and stored securely and for the sole purpose of processing the purchase of services. Harmony Bikes Limited reserves the right to contract any payment platform available on the market, which processes your data for the sole purpose of processing the purchase of services.

 

5. TRAVEL INSURANCE

Users must ensure that they have travel insurance before booking or purchasing any tours, rides or holidays. Harmony Bikes Limited may at its sole discretion require travel insurance prior to booking any holiday, tour or ride. It is the responsibility of the user to have insurance that suits the needs of each user including any pre-existing medical conditions of the user. The user must ensure that the travel insurance has cover for cancellation or curtailment of the holiday in the event of unforeseen circumstances, inability to travel or force majeure, personal accident, personal liability, medical expenses for illness and accident, repatriation expenses in the event of medical necessity and cover for costs and liability in connection with the activities related to the rides, tours and holidays in which the user wishes to participate. Check the conditions of your insurance policy appropriately and make sure you are covered according to your needs.

Please note that any recommendations and advisories issued by the UK Foreign, Commonwealth and Development Office in relation to domestic and international travel may have implications for your travel insurance cover. Please check the terms and conditions of your travel insurance in detail before purchasing any insurance.

 

6. APPROPRIATE BEHAVIOUR

We expect appropriate behaviour from our clients in consideration of other people, staff members, other clients and property. Users and clients must behave in an appropriate manner during trips and holidays so as not to cause any damage, endanger or endanger or cause any nuisance of any kind to any member of staff, other users and property.

Harmony Bikes Limited reserves the right to cancel any trip or holiday of any client or clients, if we reasonably consider that the client or clients are behaving in an inappropriate manner and have caused or may cause harm, danger or nuisance of any kind to other clients, members of the team and property. In the event that Harmony Bikes Limited terminates the rides, services and holidays of users who behave inappropriately, the client or group of clients shall leave any accommodation and shall be responsible for arranging the return journey. Harmony Bikes Limited shall not be liable or refund the client for service cancellations or rearrangement of the return travel of clients who have behaved inappropriately during the provision of services.  The above does not exclude clients who have behaved inappropriately and have caused any damage to another customer, property or any member of the team from paying for such damage and making appropriate compensation. The client or any member of the client's party shall be liable for any damage caused during the holiday and the conduct of the tours. Harmony Bikes Limited shall not at any time be liable for any damage caused by any client during the holiday and the conduct of the rides.

 

7. DISCLAIMER

By booking and purchasing the tours, rides or holidays you agree and declare that you wish to participate in the tours, rides or holidays where means of transport such as bicycles will be used.

You acknowledge and agree that there may be risks associated with your participation in the tours, rides or holidays including, without limitation, unfavourable weather conditions, accidents or physical injury. By scheduling and participating in the tours, rides and holidays, you agree to accept such risks associated with participation in the tours, rides or holidays and that you will not make any claim against Harmony Bikes Limited in relation to such risks.

You agree and represent that you are in good health and that you are not suffering from any injury or physical disability that would prevent you from actively participating in the tours, rides or holidays. Harmony Bikes Limited shall not be liable for any injury or damage you may suffer as a result of being unfit to participate in the tours, rides or holidays.

By accessing the website and scheduling and purchasing services, the user accepts personal responsibility for the results of their actions. You agree to assume full responsibility for any damage or injury you suffer as a result of your attendance on the tours, rides or holidays booked through the website. You agree to use your judgement and exercise due diligence before taking any action or applying any advice suggested or recommended through the website, services and attendance at tours, rides and holidays.

Harmony Bikes Limited shall not be liable for any special or indirect loss or damage caused to any person or group of persons, even if we have been informed of situations where such loss or damage may occur. Please note that the user or customer is solely responsible for any loss or damage they may cause due to their behaviour or actions. The user is solely responsible for any damage to property that may occur during tours, rides or holidays.

By accessing the website and the content available on the website, you accept personal responsibility for the results of your actions in applying any information or advice suggested by Harmony Bikes Limited on the website. Harmony Bikes Limited provides resources and content for informational purposes only; you acknowledge that your ultimate success or failure will be the result of your own efforts, your particular situation and a variety of circumstances beyond Harmony Bikes Limited's control.

Harmony Bikes Limited does not intend to limit or exclude its liability for damages caused to any person by situations attributable to Harmony Bikes Limited or any of its employees or associates. Harmony Bikes Limited does not purport to limit or exclude any other liability which cannot be limited or excluded by applicable law.

 

8. THIRD-PARTY MATERIALS.

“Third-Party Materials” means any content, images, videos, texts or other material that is owned by a third party, such as stock images, videos and texts. Such Third-Party Materials are subject to the applicable third-party terms and licenses, and may only be used as permitted by such terms and licenses.

 

9. COPYRIGHT

All materials on Harmony Bikes Limited, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, software and other elements are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Harmony Bikes Limited or by third parties that have licensed or otherwise provided their material to the website. You acknowledge and agree that all Materials on Harmony Bikes Limited are made available for limited, non-commercial, personal use only. Except as specifically provided herein. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without Harmony Bikes Limited prior express written permission. These terms do not affect your statutory rights as a consumer which are available to you.

Subject as aforesaid, to the maximum extent permitted by law, Harmony Bikes Limited excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Harmony Bikes Limited and Harmony Bikes Limited shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

Any award rendered by the arbitration tribunal shall be final and conclusive on the parties.

To the fullest extent permitted by law, you agree that you will not file, join or participate in any class action lawsuit in connection with any claim, dispute or controversy that may arise in connection with your use of the website and services.

The courts of the United Kingdom shall have jurisdiction over any dispute, controversy or claim relating to Harmony Bikes Limited and its business operations. Any such dispute or controversy shall be brought and resolved in the courts of the United Kingdom.
